The deadline for submission of claims has passed, processing of claims has been completed and the Court has approved the distribution of the Net Settlement Fund to Authorized Claimants pursuant to the Court-approved Plan of Allocation.
On November 24, 2010, the Claims Administrator mailed distribution checks to all eligible Authorized Claimants, i.e., Authorized Claimants whose pro rata distribution amount was $20.00 or more. As set forth in the Plan of Allocation, which is included in the Notice of Pendency of Class Action and Proposed Settlement, Settlement Fairness Hearing and Motion for Attorneys’ Fees and Reimbursement of Litigation Expenses (the “Notice”) at pages 8-12, if an Authorized Claimant’s prorated payment calculates to less than $20, it will not be distributed (paragraph 53 of the Notice at page 10).
PLEASE NOTE: The distribution amount, which is the amount of the check that was sent, is not the same as the Recognized Claim amount. The Recognized Claim amount is the amount calculated under the formula set forth in the Plan of Allocation and is used to determine how the Net Settlement Fund is to be proportionately allocated to Authorized Claimants. The distribution amount is an Authorized Claimant’s pro rata shareof the Net Settlement Fund, based the amount of his, her or its Recognized Claim compared to the total amount of all Recognized Claims of Authorized Claimants to be paid from the Net Settlement Fund.
